Initial ASR Case Management Conferences Held In Early June

Multiple Case Management Conferences (CMCs) regarding the ASR litigation in multiple jurisdictions have been held in these first couple weeks in June. On June 1, Judge Brian Martinotti hosted a joint CMC in Bergen County, NJ along with Judge David A. Katz, who is presiding over the federal cases in the multidistrict litigation centered in the U.S. District Court for the Northern District of Ohio. Additionally, the first CMC for the California consolidated cases to be presided over by Judge Richard Kramer was held at the San Francisco Superior Court.

So, what does this mean for the proceedings? A CMC is simply a pre-trial meeting between the judge, the parties, and the lawyers representing the parties to settle some of the issues pertinent to the case. In the DePuy ASR CMCs, the parties agreed to some discovery matters and scheduled further meetings. The next DePuy ASR CMC will take place for the California plaintiffs in early July. The federal plaintiffs will have theirs in late July.

At this point in the litigation, the respective judges are trying to streamline the logistical and procedural issues like discovery so the trial may move forward in an expedient and efficient manner. The parties will be exchanging a wealth of information, such as medical records and information related to the costs incurred as a result of the product’s alleged failure. Once all the necessary information to formulate case strategy has been received by each respective party, the trial dates will be set and the case can move forward.

Though we are early in the process, the ASR lawsuits are progressing and now is the time to decide if you have a claim against DePuy.
